This Privacy Policy is effective as of September 14, 2018.

Here at Rimeto LLC (“Rimeto”), we are always committed to protecting your privacy and encourage you to read and learn more about the terms of our privacy policy (“Privacy Policy”). By visiting Rimeto’s Site or App, accessing Rimeto’s proprietary software (the “Software”) or using any of our services (collectively, with the Software, the “Service”), you acknowledge that you accept the practices and policies outlined in this Privacy Policy. Terms not defined herein shall have the meaning as provided in Rimeto’s Terms of Service found at https://www.rimeto.com/tos and incorporated herein.

WE MAY MODIFY THIS PRIVACY POLICY AT ANY TIME, IN OUR SOLE DISCRETION, AND SUCH MODIFICATION SHALL BE EFFECTIVE IMMEDIATELY UPON EITHER POSTING OF THE MODIFIED PRIVACY POLICY ON THE SITE, ON THE APP, OR NOTIFYING YOU. USE OF INFORMATION WE COLLECT NOW IS SUBJECT TO THE PRIVACY POLICY IN EFFECT AT THE TIME SUCH INFORMATION IS COLLECTED. YOU AGREE TO REVIEW THIS PRIVACY POLICY PERIODICALLY TO ENSURE THAT YOU ARE AWARE OF ANY MODIFICATIONS. YOUR CONTINUED ACCESS OR USE OF THE SITE, APP AND/OR SOFTWARE SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED PRIVACY POLICY.

  1. Information Covered in This Privacy Policy; EU-U.S. Privacy Shield; EU General Data Protection Regulation.

    • This Privacy Policy covers Rimeto's treatment of Personal Information (as defined herein) that Rimeto gathers when you are accessing the Site and/or App and when you use any part of the Service. This Privacy Policy also covers Rimeto's treatment of any Personal Information that Rimeto's business partners share with Rimeto. This Privacy Policy does not apply to the practices of companies that Rimeto does not own or control, or to individuals that Rimeto does not employ or manage.

    • EU-U.S. Privacy Shield.

      1. For the purposes of this Privacy Policy, “Data Subject” means the individual to whom any given Personal Data covered by this EU-U.S. Privacy Shield policy refers; “Personal Data” means any information, including Sensitive Data, that is (x) about an identified or identifiable individual and (y) received by Rimeto in the U.S. from the European Economic Area in connection with the Service; and “Sensitive Data” means Personal Data regarding an individual's racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, physical or mental health, or sexual life.

      2. Rimeto complies with the EU-U.S. Privacy Shield Framework (the “Privacy Shield Principles”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information transferred from the European Union (“EU”) to the United States. Rimeto has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.       3. In compliance with the Privacy Shield Principles, Rimeto commits to resolving complaints about Rimeto’s collection or use of your Personal Data. EU individuals with inquiries or complaints regarding Rimeto’s EU-U.S. Privacy Shield policy should first contact Rimeto at hello@rimeto.com. Rimeto is further committed to cooperate with EU data protection authorities (“DPAs”) with regard to unresolved Privacy Shield complaints. If you do not receive timely acknowledgment of your complaint from Rimeto, or if Rimeto has not addressed your complaint to your satisfaction, please contact the EU DPAs for more information or to file a complaint. The services of EU DPAs are provided at no cost to you. Under certain conditions, more fully described on the Privacy Shield website, https://www.privacyshield.gov/article?id=How-to-Submit-a-Complaint, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

      4. Data Subjects in the European Economic Area generally have the right to access their Personal Data that is covered by this Privacy Policy. Data subjects may access their Personal Data through their Rimeto Account or by contacting Rimeto at hello@rimeto.com.

      5. If Personal Data covered by this Privacy Policy is to be used for a new purpose that is materially different from that for which the Personal Data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party, Rimeto will provide Data Subjects with an opportunity to choose (opt-out) whether to have their Personal Data so disclosed or used. Requests to opt out of such uses or disclosures of Personal Data should be sent to: hello@rimeto.com. If Sensitive Personal Data covered by this Privacy Policy is to be used for a new purpose that is different from that for which the Personal Data was originally collected or subsequently authorized, or is to be disclosed to a third party, Rimeto will obtain the Data Subject’s explicit consent (opt-in) prior to such disclosure or use of Sensitive Personal Data.

      6. Rimeto submits to and is subject to the investigatory and enforcement powers of the Federal Trade Commission and any other U.S. authorized statutory body with regards to our self-certification and implementation of the Privacy Shield Principles.

      7. In the event Rimeto discloses Personal Data to a third party, it will do so for limited and specified purposes and consistent with any notice provided to Data Subjects and any choice they have exercised regarding such disclosure. Rimeto will only disclose Personal Data to third-party agents that have given Rimeto assurances that they will safeguard such Personal Data in a manner that is consistent with the Privacy Shield Policy. If Rimeto has knowledge that a third party to which it has disclosed Personal Data covered by this Privacy Policy is using, disclosing, and/or processing such Personal Data in a way that is contrary to the Privacy Shield Principles, Rimeto will take reasonable steps to prevent or stop such use, disclosure, and/or processing. Rimeto may be liable for onward transfers of Personal Data to third parties in violation of the Privacy Shield Principles.

    • EU General Data Protection Regulation Compliance. Rimeto customers (not Rimeto), determine the purpose and means of processing Personal Information (defined below) of EU persons provided to Rimeto by or at the direction of such customers. Rimeto performs such processing in accordance with this Privacy Policy and the terms of data processing agreements executed by Rimeto and such customers. Rimeto’s customers are responsible for disclosing the rights and terms for processing of Personal Information in accordance with the EU General Data Protection Regulation.

  2. Collection of Your Information.

    • In order to access the Service, you will be required to register for a Rimeto Account. In connection with the Service, Rimeto may collect the following information: (i) certain personally identifiable information (“Registration Information”), such as your name, title, e-mail address, addresses, telephone number, profile photo, and birthday; and/or (ii) by allowing us to access your name and other profile information through existing accounts you may have on the third party registration services (each an “TPS”, and your TPS profile, the “TPS Profile”). In addition, we may ask you to provide certain work-related information and/or, mobile location information, if you have installed our App and permitted your mobile or other location-aware device to transmit location data (“Work Information” and collectively with the Registration Information and Personal Data, the “Personal Information”), such as your reporting, hiring date, ongoing projects, and work goals. It is your responsibility to give us current, complete, truthful and accurate information, including Personal Information. Rimeto will not be responsible for any problems or liability related to inaccurate or incomplete Personal Information, whether due to your failure to update such Personal Information or otherwise. If you register for an Account through the use of a TPS Profile, in addition to providing us with certain Personal Information as we use the information you have already provided to the TPS in registering for an account and which you have allowed the TPS to share with Rimeto, including, but not limited to, your first name, your TPS user profile picture, your friends list, pages you are a fan of, your gender, and the networks to which you belong (collectively, your “Submitted Information”).

    • In addition to the Personal Information and Submitted Information, we may collect the following information provided through the Services (collectively with Personal Information and Submitted Information, the “Information”):

      • Information from publicly accessible sources, such as blogs and comments from other Users.

      • Certain standard browser information, such as your browser type, IP address, and access times.

      • Version of the Software you are using and language code of the device where you installed the Software.

      • Calendaring program information that may be accessed through web-based calendaring programs and/or if you download and install the Software.

      • Contacts from your email and/or contacts apps that you allow our Services to access.

      • Information from project management and performance applications that you allow our Services to access.

    • In using and/or accessing the Services or the Software, you expressly authorize us to collect and use your Information in connection with the Services. You further acknowledge and agree that Rimeto may, but is not obligated to, maintain copies of your Information indefinitely, or delete any or all Information, at our sole discretion. When you receive promotional e-mails or newsletters from Rimeto, if any, we may use customized links or similar technologies to determine whether such newsletters or e-mail has been opened and which links you click. This information is used to provide you more focused e-mail communications and/or other information.

  3. Use of Your Personal Information. Rimeto collects and uses your Information to operate and improve the Site and the App and better deliver the Services. These uses may include performing analysis aimed at improving the Service; making the Site, the App or Services more user friendly by reducing the need for you to repeatedly enter the same information; and displaying content that are tailored to your preferences and interests. If you registered for an Account through your TPS Profile, Rimeto will not knowingly use, display, or share any of your Information in a manner inconsistent with the privacy settings and policies of the TPS (collectively, the “TPS Policies”) which you registered through. We advise you to carefully read the terms of use and TPS Policies that you access the Services through. It is your responsibility to read and accept the respective TPS Policies prior to accessing and using the Services.

  4. Disclosing of Your Personal Information to Third Parties.

    • Rimeto does not sell, rent, lease or disclose your Personal Information. Except as described in this Privacy Policy, your Personal Information will be used only by Rimeto and its controlled subsidiaries and affiliates, and your Personal Information will not be disclosed to any other third party without your consent. By accessing your Account, you may choose to share your Personal Information with select Rimeto partners so that they can contact you about their respective products, services or offers.

    • Rimeto may hire other companies to provide limited administrative and communication services on Rimeto’ behalf, such as hosting Sites, the processing and delivery of mailings or providing customer support. Rimeto has the right to disclose your Personal Information to these third-party companies for the purpose of administering and maintaining the Site and App’s features, functions, and operations. Those companies will be permitted to obtain only such Personal Information as necessary for them to deliver the respective services, and Rimeto does not authorize these companies to use your Personal Information except for the sole purpose of providing those services requested by Rimeto.

    • For online payments, Rimeto may use the payment services provided by third-party service provider (the “Processor”)(e.g., Stripe, Bill.com, etc.). Rimeto does not process, record, or maintain your credit card or bank account information, and all of your information is stored securely on such Processor’s database. For more information on how payments are handled, or to understand the data security and privacy afforded such information, please refer to the Processor’s terms of service and the Processor’s privacy policy. We may at times change our third-party payment processor. The processing of payments will be subject to the terms, conditions and privacy policies of such third-party payment processor.

    • In addition, Rimeto may use third party analytics providers and products to obtain, compile and analyze Information about how Users are using and interacting with Rimeto and/or the Services. Rimeto may provide Information to these analytics providers for the purpose of obtaining statistics and other information about how users are using and interacting with Rimeto. These analytics providers may use a variety of established or new tracking technologies or tools (including, without limitation, cookies, web beacons, HTTP cache, local shared objects and persistent identifiers) to recognize your computer or device and/or to collect or compile this information. Rimeto has no control over the technologies, tools or practices of the third parties that providing analytics products and services to Rimeto.

    • You understand and agree that Rimeto may access and/or disclose Personal Information about you or your Account without your prior consent if Rimeto has a good faith belief that such action is necessary to: (i) comply with legal process or other legal requirements of any governmental authority, including national security or law enforcement obligations and applicable law, rule, order, or regulation; (ii) protect and defend the rights or property of Rimeto (including the enforcement of our agreements); (iii) enforce the Terms of Service; (v) operate or conduct maintenance and repair of the Site, the App or equipment as authorized by law; (vi) act in urgent circumstances to protect the personal safety of users of Rimeto Site, the App or members of the public; or (v) comply with a bankruptcy, merger, acquisition, transfer of control, joint venture of other business combination. Rimeto is not required to question or contest the validity of any search warrant, subpoena or other similar governmental request that we receive.

    • In some cases, Rimeto may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if Rimeto, or substantially all of its assets, were acquired, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of Rimeto may continue to use your Information as set forth in this Privacy Policy.

  5. Customer Data. If you register an Account on behalf of a Company, the following provisions shall apply:

    • In using the Services, you may be providing to Rimeto or uploading to your Account information regarding information (the “Customer Data”) about your employees, contractors, and/or agents (collectively, the “Service Providers”). Such Customer Data may include or be linked to Personal Information of such Service Providers (“Service Providers Personal Information”) and/or to non-personally identifiable information of such Service Providers including IP address, zip codes, browser type, and geo-location. Customer Data is stored on Rimeto’s web servers and databases (including those hosted on third-party servers on behalf of Rimeto) for use in providing the Services. In using and/or accessing the Services, you expressly authorize Rimeto to collect and use Customer Data in connection with the Services.

    • You understand, acknowledge and agree that Rimeto contractually requires you to (a) abide by all applicable state, federal and international laws, rules and regulations, including all terms and conditions set forth in the Terms of Service, as well as other applicable laws relating to privacy, data collection and transfer of Customer Data; and (ii) obtain any necessary consents from applicable third parties, including from your Service Providers, in connection with such use of its Services. You agree to comply with all applicable law, rules, and regulations regarding the collection of Customer Data. You further agree that Rimeto cannot be held responsible for your use or collection of Customer Data that is not permitted under this Privacy Policy or otherwise.

    • Rimeto may use Customer Data in performing the Services for you, including analyzing such Customer Data to help you evaluate and understand such Customer Data. Except as set forth in this Privacy Policy, Rimeto does not sell, rent, lease or disclose Customer Data, and Customer Data will be used only by Rimeto and its controlled subsidiaries and affiliates. Customer Data will not be disclosed to any other third party without your consent. Customer Data, including any Personal Information contained therein, may also be shared with certain third-party companies and individuals that help facilitate technical and administrative aspects of the Service (e.g., credit card processing), or perform functions related to the administration of Rimeto (e.g. hosting services). These third parties perform tasks on Rimeto’s behalf and are contractually obligated not to disclose or use Customer Data for any other purpose, and to employ adequate security measures to prevent unauthorized access to such data. However, Rimeto is not responsible in the event that Customer Data, including any Personal Information contained therein, is disclosed at a result of a breach or security lapse by any such third party.

  6. Security of Your Personal Information. The Personal Information Rimeto collects is securely stored within our database, and we use standard, industry-wide practices such as firewalls, encryption, and (in certain areas) Secure Socket Layers (“SSL”) for protecting your information. However, as effective as encryption technology is, no security system is impenetrable. Rimeto cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to Rimeto over the Internet. Rimeto recommends that you not disclose your password to anyone.

  7. Information Collected Automatically.

    • We may receive and store certain types of information whenever you interact with the Site, the App, and/or Service. Rimeto may choose to automatically receive and record information on our server logs from your browser including your IP address, cookie information, and the page you requested. Rimeto uses "cookies" to collect non-personal data and information. Cookies are small text files a Site uses to recognize repeat users and is typically placed on your hard disk by a web page server. Cookies contain information that can later be read by a web server in the domain that issued the cookie to you. The way cookies function is by assigning a number to the user that has no meaning outside of the assigning Site. You should be aware that Rimeto cannot control the use of cookies (or the resulting information) by Rimeto's third-party partners or advertisers. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to sign in or use other interactive features of the Site and Service that depend on cookies.

    • Additionally, if the settings on your location-aware device allow us to receive Location Information, we will collect that automatically. If we associate Location Information with other Personal Information, this Privacy Statement governs how we would use that information too.

  8. Collection and Use of Children's Personal Information. The Site, the App, and the Services are intended for general audiences, and Rimeto does not knowingly collect any Personal Information from children.

  9. E-mail Communications. Upon registration for an Account or using the Services, we may send you e-mails. If you do not want to receive e-mail or other mail from us, please notify us by e-mail at hello@rimeto.com and include sufficient information for us to identify your account, including your name, email address and the specifics of your request. However, after you unsubscribe to cease receiving e-mails, Rimeto may still contact you via e-mail for administrative or informational purposes, including messages regarding the administration of your account and/or any services or events to which you have registered.

  10. Questions or Comments Regarding this Privacy Policy. Rimeto welcomes any and all questions, comments, or complaints you may have regarding this Privacy Policy or if you do not understand any information about how we collect, maintain, use, or share your Personal Information.
